The process is conducted by a lawyer/attorney, who drafts the affidavit of free will for the girl/woman and after she signs it, then a Pandit solemnizes the marriage according to Hindu traditions. This type of marriage was previously not recognized by the Hindu religion, but now it is recognized and it is also valid under Pakistani law.

There are certain requirements that need to be fulfilled in order to solemnize a Hindu court marriage in Pakistan. Firstly, both the bride and groom should be Hindus. Secondly, they should have attained the age of majority, which is 18 years for males and females, as per Pakistani law. Thirdly, they should not be related to each other within the prohibited degrees of consanguinity or affinity, as laid down by Pakistani law. Lastly, they should give their free and full consent to marry each other.

These documents include Proof of Date of Birth of both parties, National Identity Cards of both parties, two passport-size photographs each and an Affidavit by both parties stating that they are not related to each other within the prohibited degrees of consanguinity or affinity.

In spite of the criteria for a Hindu court marriage needing to be met, if evidence exists that this was not done prior to the ceremony, the union shall not be legally binding. In addition, if either spouse has been coerced or deceived into the marriage, they may approach a court and seek to have it declared void.
